General Terms and Conditions for the PAUL KADJO Online Shop

1.Scope of application

1.1 The following General Terms and Conditions (GTC) apply to all business relations between the customer and PAUL KADJO, Mönckebergstrasse 2-4, 20095 Hamburg. The general terms and conditions apply in the version valid at the time of the order.

2. Contracting parties, conclusion of contract

2.1 The contract of sale is concluded with PAUL KADJO.

2.2 The presentation and advertising of items in our online shop does not constitute a binding offer to conclude a purchase contract.

2.3 A purchase contract is only concluded when PAUL KADJO confirms the customer's order in writing. An automatic confirmation of receipt of the order does not constitute a binding contract.

3. Custom made items

3.1 Marked products ( BiaBa / Puffer Seat, BlatraLai / Dress,  Gbobgo / Bucket Hat, KleBa / Fisherman Hat, KleDan / Beanie, KomiaBa (Double) / Chain, KomiaBa (Single) / Chain, PataBa / Shoulder Bag, PataDan / Bag, SaaBa (Double) / Bracelet, TanniBa / Small Scarf, TanniDan / Big Scarf, TraLai / Crop-Top, Vest, YasuaTralai / Slipover) from PAUL KADJO are custom-made, unique items. Production is based on the individual information and requirements of the customer.

4.Right of cancellation

4.1 You have the right to revoke this contract within fourteen days without giving reasons. However, this right of revocation does not apply to contracts for the delivery of goods that are manufactured according to customer specifications or are clearly tailored to personal needs (§ 312g paragraph 2 sentence 1 BGB), such as our products marked as "made to measure".

5. Terms of payment

5.1 Payment may be made using the following payment methods and their associated conditions: (credit card, PayPal, Klarna).

5.2 Payment of the purchase price is due immediately upon conclusion of the contract, unless expressly agreed otherwise.

6. Production and delivery conditions

6.1 Production of the item ordered will commence 24 hours after the order has been confirmed.

6.2 As each product is custom-made and unique, delivery times may vary. PAUL KADJO will inform the customer of the expected delivery date in good time.

7. Right of cancellation8. Governing law

7.1 The customer has the right to cancel the order within 24 hours of the order confirmation. After this period, PAUL KADJO will start production and cancellation will no longer be possible.

8. Governing law 9. Alternative dispute resolution

8.1 Contracts between us and you shall be governed exclusively by German law, excluding the provisions of the United Nations Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer law provisions of the country in which you have your habitual residence shall remain unaffected by the choice of law (in particular with regard to the conclusion of the contract and warranty law).

9. Alternative dispute resolution

9. 1 The European Commission provides an Online Dispute Resolution (ODR) platform with further information available on the internet at https://ec.europa.eu/consumers/odr/.

9.2 However, we will not participate in any formal dispute resolution procedure before a consumer dispute resolution body.

10. Retention of title

10.1 The goods remain the property of PAUL KADJO until payment has been made in full.

11. Severability clause

11.1 Should one or more provisions of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions.
